Codes get amended locally, thresholds and fees change, and building officials apply judgment case by case. Two houses on the same street can get different answers. Do your own research with the building and planning departments that actually have jurisdiction over your parcel, and have a qualified professional look at your specific property and scope — a designer, a registered engineer, or a licensed architect, depending on what the project turns out to need — before you make decisions or spend money on the strength of anything you read here.

The short version. An addition to a single-family wood-frame house, staying within two stories and a basement, is exempt from the architect requirement under BPC § 5537. But additions are the residential project type most likely to need engineering, because you are attaching new structure to old structure that was never designed to carry it. Architect: usually no. Engineer: usually yes.
Why additions are different from other remodels
A kitchen remodel changes what is inside the envelope. An addition changes the envelope itself, and that pulls in three things a purely interior project avoids.
New load on old structure. The existing foundation, walls and framing were sized for the house as built. An addition — particularly a second story — asks them to carry more. Whether they can is a calculation, not an opinion.
The joint between new and existing. Two structures of different ages, stiffnesses and settlement histories, connected together. In a seismic region this is a real engineering problem: the two parts want to move differently, and the connection has to accommodate or resist that.
The zoning envelope becomes binding. Setbacks, height limits, lot coverage, floor-area ratio, daylight planes. An interior remodel rarely touches these. An addition is defined by them, and they are the constraint that most often forces a redesign when discovered late.
The licensure answer
BPC § 5537(a) exempts plans for single-family dwellings of woodframe construction not more than two stories and basement in height. An addition to such a house, keeping it within that description, is inside the exemption. No architect required.
§ 5537(b) then requires that any portion deviating from substantial compliance with conventional woodframe framing be prepared by or under the responsible control of a licensed architect or registered engineer.
On additions, that second clause bites often. Which is why the standard arrangement looks like this:

A reminder, because it matters here. The rules above are the general shape of California law and common local practice as of August 2026, drawn from public sources. They are estimates, not guarantees, and they have not been checked against your parcel. Cities and counties amend the building code locally and building officials have discretion on individual projects.

When an addition does need an architect
- The finished building exceeds two stories and a basement. Adding a third story takes you out of the exemption.
- The construction is not woodframe. Steel or concrete moment frames as the primary system, masonry bearing walls — outside the exemption’s terms.
- The addition creates a fifth dwelling unit. The exemption caps at four.
- You want full architectural services — concept through construction administration under one licensed party. A legitimate choice, just not a legal requirement.
The second-story addition, specifically
This is the question we are asked most, so it deserves its own answer — and we have written about second-story additions in more depth here. A second story added to a single-story house, keeping the building woodframe and at two stories plus basement, remains inside the § 5537 exemption. No architect required on licensure grounds.
It will need engineering, essentially always, for reasons that compound:
- The existing foundation was sized for one story of load
- Ground-floor walls become bearing walls carrying a floor they were not built to carry
- The lateral system changes fundamentally — a two-story building resists earthquake and wind loads differently, and the ground floor now has to brace the story above
- Existing framing frequently turns out to be undersized by current standards once it is opened up and measured
There is also a planning dimension that catches people. Many jurisdictions treat second-story additions as a discretionary trigger — the City of Monterey, for instance, sends second-story additions in several named neighborhoods to architectural review, along with story poles and neighbor notification. That is a separate process from the building permit, on its own schedule.
And one thing worth knowing before you commit
If the existing house has no original drawings — normal for anything built before the 1970s — the first deliverable is an as-built set: a measured record of the house as it actually stands. Every downstream piece depends on it. The engineer cannot calculate against a house nobody has measured, and the design cannot be tested against the zoning envelope without accurate existing dimensions.

- Title 24 energy documentation — required where conditioned floor area is added, which is what an addition is
- Stamped structural calculations for the engineered portions
- A separate planning package where discretionary review applies
How to sequence it so nothing surprises you
- Zoning envelope first. Before any design, establish what the parcel will actually permit — setbacks, height, coverage, and whether discretionary review is triggered. This is a records check, not a design exercise, and it costs almost nothing.
- As-built measure. Document what is there.
- Schematic options against the envelope. Two or three, priced roughly, so the constraint shapes the design rather than truncating it later.
- Bring the engineer in at design development, not at construction documents. Early input on where structure wants to go is cheaper than redrawing around it.
- Construction documents and coordination. The architectural set and the structural set have to agree — this is where a lot of submittals fail.
- Submit, then answer the corrections. Comments are normal. Someone who understands the drawings should be the one responding to them.
